The Commodity Futures Trading Commission has responded in court to challenge CME Group's legal standing in an ongoing dispute over perpetual futures contracts. CoinDesk, Moomoo, and CoinMarketCap all reported that the regulatory agency argued CME Group has not shown imminent financial injury resulting from new policy approvals. [1][2][3][4][5][6]
According to CoinDesk and bloomingbit, the dispute arose after the regulator approved the first domestic bitcoin perpetual futures contract from Kalshi in May. The regulator stated in its court filing that claims of increased market competition do not provide CME Group with the legal standing required to challenge the decision. [1][6]
The Commodity Futures Trading Commission is an independent federal agency created in 1974 that regulates derivatives markets in the United States, including futures, swaps, and options. As FTMQ Crypto reported earlier, regulated exchanges under the agency have previously self-certified crypto perpetual futures contracts, such as SEI token derivatives listed on OG.com Markets. [7][8]
CoinMarketCap reported that the federal agency is now pressing the court to toss out the lawsuit filed by CME Group. The outcome of the legal challenge could shape the broader regulatory framework for trading perpetual futures contracts within the United States. [1][4]
